1. Agreement to Terms

By accessing or using the Go Pilates Academy website, enrolling in any of our certification programs, or purchasing any products or services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use our services.

These Terms constitute a legally binding agreement between you and The Pilates Academy LLC, a limited liability company organized under the laws of the State of Delaware, doing business as Go Pilates Academy.

2. Eligibility

You must be at least 18 years of age to use our services and enroll in our certification programs. By using this website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements.

3. Description of Services

Go Pilates Academy offers online Pilates instructor certification programs, including but not limited to: Mat-Only Certification, Mat + Reformer Certification, and Comprehensive Certification. Our services include digital course content, video curriculum, live mentorship sessions, student kits, and related educational materials.

Important: Our programs are educational in nature. Completion of a certification program does not guarantee employment, income, or specific career outcomes. Individual results may vary based on effort, market conditions, and other factors beyond our control.

4. Account Registration and Security

When you create an account on our platform, you are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for all activity that occurs under your account.

You must notify us immediately if you become aware of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

5. Pricing and Payment

All prices are listed in US Dollars (USD) and are subject to change without prior notice. Current pricing for our certification programs is displayed on our website at the time of enrollment. Payment plans may be available and are subject to separate terms and conditions.

By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us to charge the applicable fees. Failure to complete payment plan installments may result in suspension of access to course materials until payment is resolved.

6. Intellectual Property

All content on the Go Pilates Academy website and within our certification programs, including but not limited to text, graphics, logos, images, video content, audio content, curriculum materials, The Flow Method™ teaching methodology, and software, is the exclusive property of The Pilates Academy LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the course materials solely for your personal educational purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of our content without our prior written consent.

Specifically, you may NOT: share login credentials or course access with others; record, screenshot, or capture course content; redistribute course materials in any form; use our content to create competing products or services; or remove any copyright or proprietary notices from our materials.

7. Medical Disclaimer and Assumption of Risk

IMPORTANT: Pilates involves physical activity and carries inherent risks of injury. By enrolling in our programs and practicing Pilates exercises, you acknowledge and accept these risks.

You represent and warrant that you are physically fit to participate in Pilates training and instruction. You are strongly advised to consult with a qualified healthcare professional before beginning any exercise program. Go Pilates Academy is not a medical provider and does not offer medical advice.

You assume full responsibility for any injuries or damages that may occur during your training, practice, or instruction of Pilates. You agree to release, indemnify, and hold harmless Go Pilates Academy, its owners, employees, contractors, and affiliates from any claims, damages, or liabilities arising from your participation in our programs or use of our content.

8. User Conduct

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our website or interfere with other users. You agree not to attempt to gain unauthorized access to any part of our website or systems. Harassment, abuse, or threatening behavior toward staff, mentors, or fellow students will result in immediate termination of your account without refund.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GO PILATES ACADEMY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE OUR SERVICES.

In no event shall our total aggregate liability to you for all claims exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

10. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall first be attempted to be resolved through informal negotiation by contacting us in writing. If the dispute cannot be resolved within thirty (30) days of written notice, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

Arbitration shall take place in the State of Delaware, or at another mutually agreed location. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You may pursue claims in small claims court if your claims qualify.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal proceedings that are not subject to arbitration shall be brought in the state or federal courts located in Delaware.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email at least fourteen (14) days before the changes take effect. Your continued use of our services after the effective date of any changes constitutes your acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

REFUND AND CANCELLATION POLICY

1. Overview

At Go Pilates Academy, we are committed to providing high-quality educational content and services. We understand that sometimes circumstances change, and we have established this Refund and Cancellation Policy to be fair and transparent for all parties.

2. Digital Course Content — 14-Day Satisfaction Window

Refund eligibility: Refund requests for digital course purchases must be submitted in writing within fourteen (14) calendar days from the date of purchase.

To qualify for a refund, ALL of the following conditions must be met:

(a) The request is submitted within the 14-day window via email to [email protected]; (b) Less than 25% of the total course content has been accessed or viewed; (c) No course materials have been downloaded, copied, or reproduced; (d) Any physical materials (student kit) have been returned in original, unopened condition; (e) A written explanation of the specific reason for dissatisfaction is provided.

3. Processing and Administrative Fees

Approved refunds are subject to a processing and administrative fee of 5% of the purchase price (minimum $5, maximum $25). This fee covers payment processing costs and administrative expenses.

4. Non-Refundable Circumstances

Refunds will NOT be provided under the following circumstances: change of mind or buyer’s remorse after 14 days from purchase; failure to access the course due to technical issues on the customer’s end (incompatible device, insufficient internet connection); dissatisfaction due to unrealistic expectations not aligned with course descriptions; failure to achieve personal fitness or career goals; requests made after accessing more than 25% of course content; violation of Terms of Service; or purchases made more than 14 days ago.

5. Student Kits and Physical Materials

Student kits that have been opened or used are non-refundable. If a refund is approved and a student kit was included in the purchase, the kit must be returned at the student’s expense in its original, unopened condition before the refund is processed. Refunds for courses that included a student kit will be adjusted to deduct the value of the kit if it has been opened or is not returned.

6. Payment Plan Cancellations

Students on payment plans who wish to cancel must do so within the 14-day satisfaction window described above. If you cancel a payment plan after the 14-day window or after accessing more than 25% of course content, you remain responsible for the full balance of the payment plan. Failure to make scheduled payments may result in suspension of course access and referral to a collections agency.

7. Major Defects and Consumer Protection

Notwithstanding the above, full refunds will be provided in the following circumstances as required by law: content that is materially and substantially different from what was described at the time of purchase; technical failures on our end that prevent access for more than seven (7) consecutive days and cannot be resolved; or missing substantial portions of advertised content that were explicitly promised at the time of enrollment.

8. Refund Process

To request a refund, email [email protected] with the subject line “Refund Request” and include your full name, date of purchase, order number, and specific reason for the request. Approved refunds will be processed within 7–10 business days to the original payment method. Upon refund processing, your access to all course materials will be immediately terminated.

9. State-Specific Provisions

California Residents: You have the right to receive a copy of this agreement. This refund policy complies with California Civil Code requirements for digital content sales.

Alabama Residents: Consistent with Alabama consumer protection law, unused digital content may be returned within 7 days. This policy exceeds state minimums.

Arkansas Residents: This policy provides protections beyond the Arkansas 5-day cooling-off rule for certain purchases.

10. Dispute Resolution for Refunds

Customers must first contact customer service in writing before pursuing any other remedies. A 30-day good faith negotiation period is required. Unresolved disputes are subject to binding arbitration as described in our Terms of Service. Customers may pursue small claims court for amounts under the applicable jurisdictional limit.

11. Company Termination Rights

Go Pilates Academy may immediately terminate access without refund for: intellectual property violations; sharing access credentials or account information; attempting to circumvent technical protection measures; fraudulent payment methods or chargebacks; threatening or abusive conduct toward company staff; or any violation of Terms of Service.

SHIPPING POLICY

Go Pilates Academy ships student kits and physical course materials to students enrolled in our certification programs. This policy outlines our shipping procedures, timelines, and responsibilities.

2. What We Ship

Physical items included with our certification programs may include student kits containing course workbooks, anatomical reference materials, branded merchandise, and other educational tools as described on each program’s enrollment page. The exact contents of student kits may vary by program and are subject to change.

3. Shipping Within the United States

Processing time: Orders are processed and shipped within 5–10 business days from the date of enrollment and payment confirmation.

Delivery time: Standard shipping within the continental United States typically takes 5–7 business days after dispatch. Delivery to Alaska, Hawaii, and US territories may take 10–14 business days.

Shipping cost: Shipping within the United States is included in the program price at no additional charge.

4. International Shipping

Processing time: International orders are processed and shipped within 7–14 business days from the date of enrollment and payment confirmation.

Delivery time: International delivery times vary by location and typically range from 14–30 business days after dispatch. Some remote locations may take longer.

Customs and duties: International customers are responsible for any customs duties, taxes, or import fees imposed by their country. Go Pilates Academy has no control over these charges and cannot predict their amount.

Shipping availability: We make every effort to ship to as many countries as possible. However, our shipping carriers may not be able to deliver to all addresses worldwide. If we are unable to ship to your address, we will notify you and work together to find an alternative solution, such as an alternate delivery address or a digital-only enrollment option.

5. Order Tracking

Once your order has been dispatched, you will receive a shipping confirmation email with tracking information. Please allow 24–48 hours for tracking information to become active after dispatch. For any questions about your shipment, please contact [email protected].

6. Delivery Issues

Incorrect address: It is your responsibility to provide an accurate and complete shipping address during enrollment. Go Pilates Academy is not responsible for shipments delivered to incorrect addresses provided by the customer. Re-shipping due to an incorrect address may incur additional charges.

Lost or damaged packages: If your package appears to be lost or arrives damaged, please contact us within 14 days of the expected delivery date. We will work with our shipping carrier to resolve the issue. If the package is confirmed lost, we will ship a replacement at no additional charge.

Unclaimed packages: Packages returned to us due to failure to claim or pick up will be subject to re-shipping charges.

7. Returns of Physical Materials

If you are eligible for a refund under our Refund and Cancellation Policy and your order included physical materials, you must return the materials in their original, unopened condition at your own expense. The refund will not be processed until the returned materials are received and inspected. If the materials have been opened or used, the value of the materials will be deducted from your refund.

8. Digital Course Access

Please note that access to digital course content is granted separately from physical shipments. Your digital course access will be provided upon enrollment and payment confirmation, regardless of the shipping status of physical materials. The delivery timeline of physical materials does not affect your ability to begin your studies online.
